Affiliation Terms


Between:

  • Tublat.com, the company providing services through the website www.tublat.com and represented by Iannotta Gianluca, with its registered office in Sant’Agata De’Goti (BN), Frazione San Silvestro 53, PEC [email protected].

And:

  • The affiliate agent, the natural or legal person who, acting in the course of their commercial, industrial, craft, or professional activity, advertises Tublat.com's services.

  1. 1. Subject of the Contract

1.1 This contract establishes the terms and conditions for participating in Tublat.com's affiliate program, through which the affiliate agent promotes Tublat.com's services.

  1. 2. Operation of the Affiliate Program

2.1 Affiliating with Tublat.com involves advertising Tublat.com products using an affiliate link provided by Tublat.com.

2.2 For each paid sale made through the affiliate link, a 15% commission will be recognized for the affiliate agent.

2.3 For products with recurring renewals, commissions will also be recurring at 15%.

  1. 3. Role of Service Manager

3.1 The affiliate agent will have a second affiliate link to invite clients to become their Service Manager.

3.2 In this role, the affiliate agent can access their clients' areas and manage services for them.

3.3 The affiliate agent's contacts will be displayed in their clients' area, and clients can contact the affiliate agent for technical and commercial support.

3.4 Clients can always contact Tublat.com support directly and purchase other services from Tublat.com, in which case the affiliate agent will still receive the 15% commission.

  1. 4. Commission Payments

4.1 When the commission balance reaches €50, at the end of the month following the referred client's purchase, the affiliate agent can issue an invoice to Tublat.com.

4.2 Payment will be made by bank transfer, if provided by the agent, or by credit recharge in the affiliate agent's client area. Credits are non-refundable and can only be used for purchasing new Tublat.com services.

  1. 5. Enrollment Requirements

5.1 A VAT number is required to join the program.

5.2 Domain names and product addons are excluded from the affiliate program.

  1. 6. Ownership and Licenses

6.1 Each party shall retain all rights, titles, and interests in its names, logos, trademarks, service marks, trade dress, copyrights, and proprietary technology.

6.2 Tublat.com grants the affiliate agent a revocable, non-exclusive, worldwide license to use Tublat.com's logos, trademarks, and service marks solely to facilitate a link between the affiliate agent's site and Tublat.com.

  1. 7. Dispute Resolution

7.1 In the event of a dispute, the only language of the proceeding will be Italian. The interested affiliate agent will have a sworn translation of this contract made into Italian at their own expense and responsibility.

7.2 Tublat.com and the affiliate agent conventionally derogate jurisdiction in favor of the Court of Benevento (Italy).

  1. 8. Contract Duration and Termination

8.1 This agreement may be terminated by either party at any time with written notice.

8.2 In case of violation of this agreement, Tublat.com has the right to immediately suspend or terminate the agreement.

  1. 9. General Clauses

9.1 The parties declare that they have full binding authority to enter into this agreement.

9.2 The affiliate agent agrees not to infringe on any third party's intellectual property rights.

9.3 The affiliate agent will not use unsolicited commercial email (SPAM) in relation to Tublat.com's affiliate program.

9.4 This agreement constitutes the entire agreement between the parties and supersedes any prior agreements.

9.5 Any modifications to this agreement must be made in writing.
