The present clauses, to be considered an integral and substantial part of the contract as they supplement it, regulate the "SOCIAL MEDIA" service offered by Tublat.com. For any matters not expressly provided for in this integration, the general terms and conditions shall apply.
Art. 1. Description of Services
1.1 Social Media Management
Tublat.com offers professional social media management services aimed at increasing visibility, audience engagement, and brand consistency across social networks. The service includes:
Content planning;
Creation of engaging posts (texts, images, and/or graphics);
Publication according to the agreed schedule;
Interaction monitoring (comments, messages).
The available Social Media packages are:
Social Basic Package – Essential Management: Management of one social profile (e.g., Facebook or Instagram). Creation and publication of four posts per month, one per week. Price: €49.99 per month.
Social Pro Package – Multi-Platform Presence: Management of two social profiles (e.g., Facebook and Instagram). Creation and publication of eight posts per month, two per week across multiple channels. Monthly activity and follower growth report. Price: €89.90 per month.
Social Premium Package – Comprehensive Coverage: Management of up to three social profiles (e.g., Facebook, Instagram, LinkedIn). Twelve posts per month with customized graphics/short-form content, three per week. Detailed reports and monthly alignment meetings. Price: €129.99 per month.
All packages include the definition of a monthly editorial strategy, a content calendar agreed with the client, and the optimization of posts with appropriate hashtags and keywords.
Art. 2. Obligations of Tublat.com
Tublat.com undertakes to:
Quality Assurance: Provide the agreed services with professionalism and high standards, using best industry practices for social content creation. All materials will be carefully checked before delivery.
Timely Execution: Adhere to deadlines and the agreed schedule. In case of unforeseen circumstances or delays, Tublat.com will promptly inform the client and endeavor to minimize any disruptions.
Correction of Errors: If the client identifies errors or discrepancies in the published content, Tublat.com will correct them promptly and at no additional cost.
Art. 3. Obligations of the Client
The client undertakes to:
Provide Access and Materials: Make available to Tublat.com all necessary access credentials (e.g., login details for managed social profiles) and base materials (e.g., logo, brand identity manual, proprietary photos/images, texts or information about products/services). These elements must be provided promptly at the beginning of the collaboration and updated in case of changes.
Ensure Clear Communication and Collaboration: Maintain timely and clear communication with Tublat.com by appointing an internal representative to interact with Tublat.com, provide feedback on proposed content, and respond to any additional information requests. Quick feedback is essential to meet deadlines.
Adhere to Payment Deadlines: Make payments to Tublat.com within the agreed timeframes. In case of late payments beyond the agreed terms, Tublat.com may temporarily suspend service delivery until regularization.
Art. 4. Payment Terms
The compensation for the chosen Social Media package shall be invoiced monthly in advance. The client must make the payment at the beginning of each service month, within the agreed date. A discount may be applied if the client opts to pay multiple months in advance (e.g., 5% discount for 6 months' advance payment; 10% discount for 12 months' advance payment).
All payments must be made via bank transfer (or another method provided by Tublat.com) to the account details specified by Tublat.com on the invoice. The indicated prices are exclusive of VAT (unless otherwise stated). Invoices will be issued by Tublat.com on a monthly basis (for recurring payments) or annually (for lump sum payments), with a payment term of 7 days from the invoice date unless otherwise agreed in writing.
Art. 5. Delivery Timeframes
The delivery and execution schedules for Social Media content are as follows:
Monthly Editorial Plan: By the 25th of the preceding month, Tublat.com will provide the client with a content calendar for the following month. The client must approve or request modifications within a few days (ideally by the 28th of the same month) to allow for scheduling.
Content Creation and Publishing: Once the plan is approved, Tublat.com will produce the content and, if necessary, submit it for final approval at least 2 days before the scheduled publication date. Posts will be published according to the frequency of the chosen package.
Reporting: At the end of each month, by the 5th of the following month, a report on Social Media activities will be sent to the client. The report will include key metrics (number of posts published, follower growth, engagement, advertising campaign performance, etc.), along with strategic recommendations for performance improvement.
Art. 6. Content Modifications
Tublat.com accepts up to two revisions per piece of content before publication. Additional modification requests will be subject to an extra fee to be agreed upon.
The client may request modifications to posts up to 48 hours before the scheduled publication. Beyond this timeframe, modifications are not guaranteed without additional costs.
Art. 7. Paid Advertising (Ads)
For packages that include advertising management, Tublat.com sets up and manages sponsored campaigns on social networks using the budget agreed upon with the client.
The advertising budget is excluded from the service cost and must be paid directly to the advertising platforms (Facebook Ads, Instagram Ads, etc.).
Tublat.com will optimize advertising campaigns based on performance metrics, providing transparent reporting on the results obtained.
Art. 8. Contract Termination
The Social Media service has a monthly duration.
The client may cancel the service from their customer area at least 15 days before the end of the current period. If no cancellation is communicated within the specified timeframe, the service will be automatically renewed for the subsequent period.
No refunds are granted for early terminations before the agreed expiration date.
Art. 9. Liability and Limitations
Tublat.com shall not be held liable for any damages resulting from modifications to social media accounts made by the client without prior consultation.
The client is responsible for the accuracy of the information provided for post creation. Tublat.com shall not be liable for any legal disputes arising from incorrect, misleading, or third-party infringing content.
Tublat.com is not responsible for any downtime or malfunctions of social media platforms (Facebook, Instagram, LinkedIn, etc.) that may impact content publication.
Art. 10. Acceptance of Terms
By activating the service, the client fully accepts the above-listed terms and conditions. Tublat.com reserves the right to update the service terms in accordance with changes in social media platforms and applicable regulations.
